INDYCAR: Dragon Racing Owner Jay Penske Arrested
Dragon Racing team owner Jay Penske and his brother Mark were arrested early Thursday morning for allegedly breaking into a house in Nantucket.

Dragon Racing team owner Jay Penske and his brother Mark were arrested early Thursday morning in Nantucket, MA, for allegedly breaking into a house at the Nantucket Yacht Club facility, according to a report published by the Nantucket Inquirer and Mirror newspaper.

The report stated that the Penske brothers "were arraigned Thursday morning on charges of breaking and entering in the nighttime with intent to commit a misdemeanor."

According to the Nantucket police, Jay Penske was confronted by a woman while he was urinating in the parking lot of the yacht club and “turned and continued to urinate on her boots. He then proceeded to grab her arm and push her. (The woman) also states that Mark before he ran away pushed her and they both then ran to the house on Yacht Club property.”

The woman declined to press charges.

In an unfortunate twist, Penske's IndyCar team carries primary sponsorship from TrueCar, whose funding supports drivers Sebastien Bourdais and Katherine Legge, with Legge representing the brand through its "TrueCar Racing Women Empowered Initiative."

The breaking and entering charge also appears to stem from the Penske's attempt to evade the police after the parking lot incident.

A call placed to Jay Penske by SPEED.com for comment went directly to voicemail.

The IZOD IndyCar Series is expected to wait on the findings by the Nantucket police and the local court system before making any decisions on whether to penalize Penske.

Rule 9.3.1 in the INDYCAR rule book governs improper conduct, and affords the series the right to punish "Any Member attempting to or engaging in unsportsmanlike conduct or conduct detrimental to racing, INDYCAR, and/or to the IZOD IndyCar Series, whether during an Event or on/off the Track."

Rule 9.3.1 was used twice in 2011 to punish Team Penske drivers Will Power and Helio Castroneves for separate incidents.

Power's outburst at the New Hampshire oval, which included giving both middle fingers to Race Control while in live TV, earned a $30,000 penalty, and Castroneves, who lambasted Race Director Brian Barnhart via Twitter after an unfavorable call at Motegi, also earned a $30,000 fine.

Series CEO Randy Bernard gave Power and Castroneves the option to perform community service to lessen the fines, which both drivers completed.

Jay and Mark Penske are the sons of legendary Indy car, NASCAR and sports car team owner Roger Penske and his wife Kathy.

This marks the second instance of drama in recent weeks for Roger Penske after AJ Allmendinger, who was hired to drive its No. 22 Sprint Cup entry, was suspended by the series and eventually fired by Penske after testing positive for a banned substance.
