A.J. Foyt Racing is the latest team to run afoul of INDYCAR's fuel capacity limits in recent weeks, and has been penalized $15,000 and 10 entrant points for racing at Toronto with more than the 18.5 gallons allowed by Rule 14.7.2.

Foyt's driver, Mike Conway, earned the team's best finish of the year at Toronto, earning third after the team went 43 races between podium visits.

This is the latest in a string of capacity-related penalties this season, and comes just two weeks after Simon Pagenaud finished third at Iowa for Schmidt Hamilton Motorsports and was later fined $5000 for racing with a fuel cell that INDYCAR's technical inspectors determined to have competed with a capacity of 18.55 gallons.

The SHM team conducted a capacity check prior to the race at Iowa and found the tank to be in compliance with the 18.5-gallon limit, and had done eight total capacity checks with the same result over the three previous rounds.

To their surprise, and with no answer as to why it had happened, an extra .05 gallons of capacity was found during the post-race tech inspection.

Although the series did not release the data on how far Conway's tank was outside of the 18.5-gallon limit, it's believed to have been more significant than what was found with the SHM car at Iowa.

INDYCAR VP of Technology Will Phillips stated "We felt the discrepancy in the size of the fuel tank was enough that it potentially could have provided a track position advantage and the penalty is reflective of that," in reference to the Foyt situation.

Compared to what SHM paid for its capacity violation, the steep fine and points penalty assigned to Foyt appears to be based on intent.

Phillips' choice of words ("potentially could have provided a track position advantage") speaks to the team racing with a fuel cell capacity that was illegal, rather than the team using that extra fuel to its advantage.

SPEED.com has learned that Conway used no more than 17 gallons during each stint at Toronto, and like SHM, the team was surprised to find its fuel cell was out of compliance.
